Anomaly pointed out in Pension entitlement in the rank of Lt Gen and above.
Adjutant General Branch (AG/PS-5) has pointed out on 14.11.2017 that some Lt. Gens. are availing lower pension amount than Brigs/Maj Gens and requested to this Ministry that the provision of Note to Para 7 of MoD letter No. 17(4)/2008/(2)/D(Pen/Pol) dated 12.11.2008 may be amended in order to rectify the anomaly. 2. Note to Para 7 of MoD policy letter dated 12.11.2008 states that “The retiring pension of an officer of the rank of Major General and equivalent, shall not be less than pension which would have been admissible to him as a Brigadier and equivalent, as the case may be, had he not been promoted to the higher rank”. Accordingly, pension has been protected upto the rank of Maj Gen. 3. AG/PS-5 has requested that the provision of MoD policy letter No. 17(4)/2008/(2)/D(Pen/Pol) dated 12.11.2008 may be extended for the rank of Lt Gen and above. 4. The matter was taken up by the Ministry with CGDA. The CGDA has examined the matter in consultation with PCDA(P) Allahabad/ PCDA(O) Pune and vide their letter dated 24.9.2021, the CGDA has forwarded the data of 381 cases, where officers in the rank of Lt Gens & above drawing pension in their respective last rank held as well as in the rank of Brigadier (had they not been promoted), to AG/PS-5 for examination. The matter is still under examination in AG/PS-5 Branch. # Individual may submit feedback in this regard, if any.
